Couples in South Dakota file lawsuit against same-sex marriage ban

Six couples have filed a lawsuit against South Dakota’s same-sex marriage ban which means that North Dakota’s marriage ban is the last remaining uncontested same-sex marriage ban in the nation.
The lawsuit itself will challenge a 1996 law passed by the Legislature and a voter-approved 2006 constitutional amendment banning gay marriage.
South Dakota Attorney General Marty Jackley said he’s obligated by law to defend the ban, although he believes that a vote would be a more appropriate path to same-sex marriage legality.
