10th Circuit Court strikes down Oklahoma’s same-sex marriage ban
by clear hat
July 18, 2014
The Federal Court of Appeals struck down Oklahoma’s same-sex marriage ban today, when a case between a California same-sex couple and a Tulsa county clerk was brought before them.
Though the court did not rule in the couple’s favor, it did find the marriage ban to be unconstitutional, following up on its decision from the Utah case.
The couple lost the case due to the fact that the county clerk had not singled them out, but rather had not issued same-sex marriage licenses at all, so was not being discriminatory against this particular same-sex couple.
A stay has been issued until the Supreme Court gets the opportunity to review the decision.
